Iress New Zealand 2023 Customer Survey Prize Draw Terms and Conditions

General

1. As part of the Iress annual client survey, Iress (NZ) Limited (453081) (“Iress”) with its registered office situated at Level 4, 40 Lady Elizabeth Lane, Wellington Central, Wellington New Zealand 6011, will conduct a prize competition (“the Competition”) according to these terms and conditions. By participating in the Competition, all entrants agree to these terms and conditions.

Competition Period

2. The Competition commences at 7am New Zealand Standard Time (NZST) on 12 September 2023 and ends on 3 October 2023. The Winner will be notified via email or phone by 5pm NZST on 20 October 2023.

Entry Criteria/How to Enter

3. The Competition is open to all New Zealand residents aged 18 years or over, who are:

a. at the date of entry, (i) employees of Iress customers; or (ii) Iress customers in a personal capacity;
b. who are personally invited by Iress, by email or by weblink, to complete the Iress Customer Experience Survey (‘Survey’);
c. complete the Survey;
d. select ‘Yes’ in response to the Survey question ‘Do you wish to be entered into the Iress Customer Experience Survey prize draw?’; and
e. do not work for Iress, Iress’ affiliates or have family members that work for Iress or Iress’ affiliates

(“Eligible Entrants”)

4. There is no other mechanism of entry into the Competition.

5. There is no entry fee for the Competition.

6. Each Eligible Entrant is allowed one entry into the draw.

Competition Criteria

7. This is a game of chance to promote Iress’ business by way of capturing client feedback with the aim to drive continual improvement across our software, services, people and processes.

8. One Eligible Entrant from New Zealand will be selected using an online random number generator which will correspond to all eligible entrants. One Eligible Entrant whose name was generated by the online name generator is the winning entry (“the Winner”).

9. Iress accepts no responsibility for entries not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

Prize (Description & Conditions)

10. The Winner will either be notified via email or phone by 5pm NZST on 20 October 2023 using the details provided in the Survey. The Winner must provide Iress with their nominated shipping address (within New Zealand) within 14 days of being notified and Iress will ship the prize to the Winner via post within 14 days of receiving the Winner’s nominated shipping address. If any Winner does not respond to Iress within 14 days, the Winner’s prize will be forfeited and Iress will be entitled to select another Winner in accordance with the process described above.

11. The Winner may elect a prize of either Apple AirPods (3rd Generation) with Lightning Charging Case ​​​​​​​with a value of $250 AUD or a $250 AUD donation made on the Winners behalf to a charity chosen by the Winner from a pre-selected list of charities compiled by Iress.

12. Iress is not responsible or liable for any loss, damage or injury suffered by any Winner as arising from, or in connection with the Prize.

13. Iress is not responsible for any terms and conditions that are associated directly with the use of the Prize.

14. The Prize must be taken as stated and no compensation will be payable if the Winner is unable to use the prize as stated.

15. The Prize is not exchangeable for other goods and services and cannot be redeemed for cash.

Privacy

16. Eligible Entrants’ personal information will be collected and used for the purpose of conducting this Competition (“Purpose”), including but not limited to: disclosure to Iress’ third party service providers, as required by law or a regulatory authority, promotional and marketing purposes, and any other purpose that is reasonably necessary for, or directly related to, Iress’ functions or activities.

17. By entering the Competition, Eligible Entrants consent to Iress’ collection and use of Eligible Entrants’ personal information for the Purpose, and in accordance with Iress’ Privacy Policy which is available at https://www.iress.com/resources/legal/privacy-policy/. Eligible Entrants should note that this URL may be subject to change but the Iress Privacy Policy will always be found on the Legal section of the Iress website.

18. By entering the Competition, Eligible Entrants agree to participate in any public relations arranged by Iress, including but not limited to Iress using their name, likeness, image and/or voice in any media platform for an unlimited period of time without payment of royalties or commission to the Eligible Entrant.

Iress’ Rights

19. By entering the Competition, Eligible Entrants grant Iress a non-exclusive licence to use the content of their entry in any way Iress wishes without payment of royalties or commission to the Eligible Entrant.

20. By entering the Competition, Eligible Entrants warrant that their submission is not in breach of any third party intellectual property rights, and agree to indemnify Iress with respect to any IP claims brought by a third party against Iress alleging that the Eligible Entrant’s submission infringes any copyright, design or trade mark intellectual property rights.

21. Iress reserves the right to exclude or disqualify any Eligible Entrant’s submission that is not in accordance with these terms and conditions, or at Iress’ discretion.

Winner’s Rights

22. The Winner has rights under any applicable New Zealand laws and regulations.

23. Notwithstanding clause 19, to the extent that it is permitted to do so under law, Iress excludes all liability arising in tort, contract or otherwise for any injury, loss or damage whether direct, indirect, special or consequential, arising in any way out of the Competition.
